CUSTOMER BOOKING TERMS AND CONDITIONS

These Customer Booking Terms and Conditions (“Terms”) form a legally binding agreement between you (“Customer”, “you”) and Safe Transfers Bogota LLC, a Wyoming limited liability company, with its principal office at 30 N Gould St # 48350, Sheridan, WY 82801, United States (“Safe Transfers”, “we”, “us”, “our”), when you request, book, or use coordination and concierge services or make any related booking through our websites, mobile applications, or other channels (collectively, the “Platform”).
PLEASE READ THESE TERMS CAREFULLY BEFORE MAKING A BOOKING. BY CLICKING “I ACCEPT”, MAKING A BOOKING, OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
If you do not agree to these Terms, you must not use the Platform or make any bookings through it.
1. DEFINITIONS
In these Terms, the following definitions apply:
1.1 “Booking” means a reservation requested or confirmed by you through the Platform for coordination of transport-related services at a specific time and place.
1.2 “Coordination Services” means the services provided by Safe Transfers consisting of arranging and coordinating, on your behalf, certain hospitality, meet-and-greet, arrival and departure assistance, and the intermediation with independent third-party transport providers, as further described in Clause 3.
1.3 “Customer” or “you” means any natural person or legal entity that uses the Platform and/or requests a Booking.
1.4 “Platform” means any website, mobile site, application, or other digital interface operated by or on behalf of Safe Transfers through which the Coordination Services are offered.
1.5 “Transport Provider” means any independent third-party driver, chauffeur, or licensed transportation company that provides transport services (the “Transport Services”) directly to you.
1.6 “Transport Services” means any services consisting of carrying passengers and their luggage by vehicle (including transfers to or from airports, cities, hotels, tours, or similar) provided directly by a Transport Provider to you.
1.7 “Service Location” means the location(s) where the Coordination Services are provided and where Transport Providers may operate, which may include, without limitation, Colombia and any other jurisdiction in which Safe Transfers offers the Platform.
1.8 “Customer Fee” means the total amount charged to you in connection with a Booking, which may be broken down into (a) a Coordination Fee, and (b) a Transport Fee, as set out in Clause 6.
1.9 “Coordination Fee” means the portion of the Customer Fee that Safe Transfers charges you for the Coordination Services.
1.10 “Transport Fee” means the portion of the Customer Fee that corresponds to the Transport Services to be provided by a Transport Provider.
2. SCOPE AND ACCEPTANCE
2.1 These Terms govern your use of the Platform and your relationship with Safe Transfers in respect of the Coordination Services only. The Transport Services are governed by a separate contractual relationship between you and the relevant Transport Provider, as described in Clause 4.
2.2 By making a Booking or using the Platform, you confirm that:
(a) you are at least 18 years old and have legal capacity to enter into binding contracts; and
(b) any information you provide is true, complete, and accurate.
2.3 Safe Transfers reserves the right to amend these Terms from time to time. The version in force at the time of your Booking will apply to that Booking. Updated Terms will be published on the Platform with the “Last updated” date.
3. NATURE OF THE SERVICES – SAFE TRANSFERS IS NOT A TRANSPORT OPERATOR
3.1 Safe Transfers provides Coordination Services only. Safe Transfers does not own or operate vehicles, does not provide Transport Services, and is not a transportation company, carrier, or professional transport operator.
3.2 The Coordination Services may include, without limitation:
(a) providing you with access to the Platform to submit Booking requests;
(b) presenting you with options for transport-related services offered by independent Transport Providers;
(c) facilitating the matching of your request with one or more Transport Providers;
(d) arranging and coordinating meet-and-greet services, including airport reception, signage, and basic luggage assistance;
(e) acting, where applicable, as a disclosed agent for Transport Providers to collect and forward payments related to the Transport Services; and
(f) providing customer support and assistance relating to your Booking and communication with Transport Providers.
3.3 Any reference on the Platform to “transfers”, “rides”, or similar terms is for convenience only and does not alter the nature of Safe Transfers’ role as coordinator and intermediary.
3.4 Nothing in these Terms, the Platform, or in the performance of the Coordination Services shall be construed as creating a relationship whereby Safe Transfers is the carrier, transport operator, or employer of any Transport Provider.
4. RELATIONSHIP WITH TRANSPORT PROVIDERS
4.1 The Transport Services are provided exclusively by independent Transport Providers. Safe Transfers is not a party to the contract for Transport Services between you and the Transport Provider.
4.2 By confirming a Booking that includes Transport Services, you agree that:
(a) Safe Transfers acts as an intermediary and, when applicable, as a disclosed agent for the Transport Provider for the limited purpose of arranging the Booking and/or collecting the Transport Fee on the Transport Provider’s behalf; and
(b) a separate, direct contract for Transport Services arises between you and the relevant Transport Provider.
4.3 Transport Providers are independent contractors, and not employees, agents, partners, or joint venturers of Safe Transfers. Safe Transfers does not control and is not responsible for:
(a) the operation of vehicles;
(b) driving decisions, routes, speed, or conduct of the driver;
(c) the condition or maintenance of vehicles; or
(d) compliance of Transport Providers with licensing, insurance, safety, or transport regulations.
4.4 Any claims, demands, or complaints arising from or related to the Transport Services (including delays, accidents, injuries, or loss or damage to property) are primarily between you and the Transport Provider. Safe Transfers may, at its discretion, assist in facilitating communication or resolution but has no obligation to assume liability for the Transport Services.
5. BOOKING PROCESS
5.1 To request a Booking, you must provide accurate and complete information, which may include:
(a) pick-up location, date, and time;
(b) drop-off location(s);
(c) passenger names, contact details, and special requirements;
(d) flight details or other relevant travel information; and
(e) luggage quantity and size.
5.2 After you submit a Booking request, Safe Transfers will use reasonable efforts to match your request with an available Transport Provider and will send you a Booking confirmation via email, SMS, or through the Platform (“Booking Confirmation”).
5.3 A Booking is considered confirmed when you receive a Booking Confirmation. Safe Transfers recommends that you review the Booking details and notify us promptly of any errors.
5.4 Safe Transfers does not guarantee that a Booking request will be accepted. Availability may vary based on location, time, demand, and Transport Providers’ capacity.
6. FEES, PAYMENT, AND INVOICING
6.1 The Customer Fee for each Booking may consist of:
(a) the Coordination Fee, payable to Safe Transfers for the Coordination Services; and
(b) the Transport Fee, payable to the Transport Provider for the Transport Services, which Safe Transfers may collect and remit on the Transport Provider’s behalf.
6.2 The Platform or Booking Confirmation will indicate:
(a) the total Customer Fee; and
(b) to the extent commercially and legally feasible, the split between the Coordination Fee and the Transport Fee, or a statement that the total amount includes both components.
6.3 You authorize Safe Transfers to:
(a) charge your selected payment method for the Customer Fee and any applicable taxes or charges; and
(b) deduct from the amounts collected the Coordination Fee and any other agreed amounts before remitting the balance to the Transport Provider.
6.4 Prices may be displayed in local currency or another currency as indicated on the Platform. Currency conversion fees charged by your bank or payment provider are your responsibility.
6.5 Taxes. Applicable taxes (including, where relevant, VAT, GST, or local sales taxes) may be charged on the Coordination Fee, the Transport Fee, or both, depending on the requirements of the Service Location and any other relevant jurisdiction.
6.6 Invoices and receipts. Upon request or as part of the booking process, Safe Transfers may:
(a) issue an invoice or receipt for the Coordination Fee in its own name; and
(b) issue, facilitate, or forward an invoice or receipt for the Transport Fee on behalf of the Transport Provider.
7. CUSTOMER RESPONSIBILITIES
7.1 You are responsible for:
(a) ensuring the information you provide for your Booking is correct and up to date;
(b) being ready at the agreed pick-up location at the specified time;
(c) complying with any reasonable instructions given by Safe Transfers or the Transport Provider regarding pick-up, luggage, or safety; and
(d) ensuring that you, and any passengers on whose behalf you book, comply with applicable laws, including immigration, customs, and safety regulations.
7.2 Luggage. You must inform us in advance of any oversized or unusual luggage. Transport Providers may refuse to carry items that are unsafe, illegal, or exceed the vehicle’s capacity.
7.3 Conduct. You must behave in a respectful and lawful manner with our staff and any Transport Provider. Transport Providers may refuse or terminate a ride if a passenger is intoxicated, abusive, poses a safety risk, or otherwise breaches reasonable conduct standards, without refund.
7.4 Travel documents. You are solely responsible for ensuring that you and any other passengers have all necessary documents (e.g., passports, visas, health documents) for your journey.
8. CHANGES, CANCELLATIONS, AND NO-SHOWS
8.1 Changes. Requests to change a Booking (such as time, location, number of passengers, or luggage) are subject to availability and may result in additional charges. Safe Transfers does not guarantee that changes can be made once a Booking is confirmed.
8.2 Customer cancellations. Safe Transfers may apply a cancellation policy, which will be communicated on the Platform and/or in the Booking Confirmation. Depending on when you cancel, you may:
(a) receive a full or partial refund of the Customer Fee; or
(b) receive no refund if the cancellation occurs within a non-refundable period.
8.3 No-shows. If you fail to appear at the pick-up location at the scheduled time, or within any applicable waiting period indicated in the Booking Confirmation:
(a) the Booking may be treated as a “no-show”; and
(b) Safe Transfers and/or the Transport Provider may retain all or part of the Customer Fee according to the applicable policy.
8.4 Cancellations by Transport Providers. If a Transport Provider cancels your Booking, Safe Transfers will use reasonable efforts to:
(a) arrange an alternative Transport Provider at no additional cost to you, where feasible; or
(b) provide a refund for the affected portion of the Customer Fee if no suitable alternative can be arranged.
9. SERVICE ISSUES, COMPLAINTS, AND SUPPORT
9.1 If you experience any issue with the Coordination Services or the Transport Services, you should promptly contact Safe Transfers using the contact details provided in the Booking Confirmation or on the Platform.
9.2 Safe Transfers will use reasonable efforts to assist with:
(a) locating the Transport Provider;
(b) clarifying pick-up arrangements;
(c) helping you communicate any complaints to the Transport Provider; and
(d) facilitating, where appropriate, partial refunds or other remedies offered by the Transport Provider or by Safe Transfers in accordance with its policies.
9.3 Any formal claims directly arising from the Transport Services (such as accidents, injuries, traffic violations, or loss of property) should be directed primarily to the Transport Provider and/or its insurer. Safe Transfers may support you in identifying relevant contact and insurance details.
10. DISCLAIMERS AND LIMITATION OF LIABILITY
10.1 To the maximum extent permitted by applicable law, and subject always to any non-excludable rights you may have:
(a) The Platform and the Coordination Services are provided “as is” and “as available”. Safe Transfers gives no guarantee that the Platform or Coordination Services will be uninterrupted, error-free, or available at all times.
(b) Safe Transfers makes no representations or warranties regarding:
(i) the quality, safety, or fitness for purpose of the Transport Services;
(ii) the conduct, actions, or omissions of any Transport Provider; or
(iii) the punctuality, reliability, or availability of any particular vehicle or driver.
10.2 Safe Transfers does not exclude or limit liability for:
(a) death or personal injury caused by its gross negligence or willful misconduct;
(b) fraud or fraudulent misrepresentation; or
(c) any liability that cannot be excluded or limited under applicable law.
10.3 Subject to Clause 10.2, Safe Transfers shall not be liable for:
(a) any indirect, incidental, special, consequential, or punitive damages;
(b) any loss of profits, revenue, goodwill, or business opportunities; or
(c) any delay or failure in the Transport Services caused by traffic, weather, road closures, or other factors outside Safe Transfers’ reasonable control.
10.4 Subject to Clause 10.2, and to the extent permitted by applicable law, Safe Transfers’ total aggregate liability to you arising out of or in connection with these Terms, any Booking, or the Coordination Services (whether in contract, tort, or otherwise) shall be limited to the amount of the Coordination Fee actually paid by you for the Booking giving rise to the claim.
10.5 Nothing in these Terms affects any mandatory consumer rights or statutory protections that you may have under the laws of the country where you reside.
11. FORCE MAJEURE
11.1 Safe Transfers shall not be liable for any delay or failure to perform any obligation under these Terms if such delay or failure results from events, circumstances, or causes beyond its reasonable control, including, without limitation, natural disasters, pandemics, war, civil unrest, terrorism, strikes, lockouts, labor disputes, government actions, road closures, or failures of telecommunications or utilities (“Force Majeure Event”).
11.2 In the event of a Force Majeure Event, Safe Transfers may suspend or cancel affected Bookings and will use reasonable efforts to assist you, but may not be able to guarantee alternative arrangements.
12. DATA PROTECTION AND PRIVACY
12.1 Safe Transfers will process your personal data in accordance with its Privacy Policy, as updated from time to time and made available on the Platform.
12.2 You acknowledge that Safe Transfers may share certain personal data (such as your name, contact details, pick-up location, and flight details) with Transport Providers to the extent necessary to perform the Coordination Services and facilitate the Transport Services.
12.3 Where required by law, Safe Transfers will obtain your consent for specific data processing activities and will honor your rights of access, rectification, and other applicable data subject rights.
13. INTELLECTUAL PROPERTY
13.1 All intellectual property rights in and to the Platform and the Coordination Services (including text, graphics, logos, trademarks, and software) are owned by or licensed to Safe Transfers.
13.2 You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for the purpose of making Bookings and using the Coordination Services in accordance with these Terms.
13.3 You must not:
(a) copy, modify, distribute, sell, or lease any part of the Platform;
(b) reverse engineer or attempt to extract the source code of the Platform, except where permitted by mandatory law; or
(c) use any automated system to access the Platform in a manner that could harm or overload it.
14. GOVERNING LAW AND DISPUTE RESOLUTION
14.1 Unless otherwise required by mandatory law of your country of residence, these Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict-of-laws principles.
14.2 The parties agree to use good faith efforts to resolve any dispute, controversy, or claim arising out of or in connection with these Terms or any Booking through amicable negotiations.
14.3 If the parties are unable to resolve a dispute amicably within thirty (30) days, either party may submit the dispute to the state or federal courts located in the State of Wyoming, County of Sheridan, which shall have exclusive jurisdiction, except where applicable law grants you the right to bring claims before courts in your place of residence.
15. MISCELLANEOUS
15.1 Entire agreement. These Terms, together with any documents expressly incorporated by reference (such as the Privacy Policy and any Booking-specific conditions), constitute the entire agreement between you and Safe Transfers regarding the subject matter and supersede any prior agreements, understandings, or representations.
15.2 Severability. If any provision of these Terms is found to be invalid or unenforceable by a court or competent authority, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
15.3 Assignment. You may not assign or transfer your rights or obligations under these Terms without Safe Transfers’ prior written consent. Safe Transfers may assign or transfer its rights and obligations under these Terms, in whole or in part, to an affiliate or successor entity, provided that such assignment does not reduce your protections under these Terms.
15.4 No waiver. No failure or delay by Safe Transfers in exercising any right, power, or remedy under these Terms shall operate as a waiver of that or any other right, nor shall any single or partial exercise of any such right, power, or remedy preclude any other or further exercise of that or any other right.
15.5 Notices. Any notices or communications to you may be provided electronically (including via email or through the Platform). You consent to receive such electronic communications. You may contact Safe Transfers at:
