Part 2 — Website Terms and Conditions

2.1 Scope and relationship with the booking terms

This website provides general information about Safe Transfers Colombia and allows you to make inquiries and booking requests.

All booking matters — including payments, cancellations, changes, wait times, responsibilities, and operational conditions — are governed exclusively by the Booking Terms and Conditions in Part 3, which apply once you make and pay for a booking.

Use of the website does not by itself create a contract until a booking is confirmed under Part 3.

2.2 Our role

Safe Transfers Colombia provides booking, coordination, and client support services for private ground transportation in Colombia. We do not own or operate vehicles, and we do not employ drivers. All transportation is performed by independent transport companies that hold the licenses, authorizations, and insurance required under Colombian law. Our role is described in full in Part 3.

2.3 Eligibility and permitted use

By using the website, you represent that:

  • You are at least 18 years old or the age of majority in your jurisdiction.
  • You have the legal capacity to enter into binding contracts.
  • You will use the website only for lawful purposes and in accordance with these Terms.

Use of the website is limited to viewing information about our services, making legitimate inquiries or booking requests, and contacting us. Any fraudulent, abusive, or illegal use is prohibited.

2.4 Changes to the website and these terms

We may modify, suspend, or discontinue the website or any part of it at any time and without notice.

We may also update these Terms from time to time. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.

2.5 Website content and availability

Website content is provided for information only. Although we work to keep it current and accurate, we do not guarantee that it is free of errors, omissions, or outdated content.

We coordinate services in Bogotá and other areas of Colombia where operational availability exists. Availability depends on factors such as location, date, time, route, and capacity. The specific conditions of a booked service are governed by Part 3 as in effect at the time of booking.

2.6 Information you provide

When you submit information through the website, you represent that it is truthful, complete, and current, that you are authorized to provide it, and that you will promptly report any relevant changes.

Incorrect, incomplete, or late information may affect the service. The operational and financial consequences are governed by Part 3. We may reject requests containing false or suspicious information.

2.7 Nature of the service

Safe Transfers Colombia is a private provider of transportation booking, coordination, and client support services.

We are not a public transportation service and not an emergency service. The website must not be used for emergency situations, which must be addressed by local emergency services.

2.8 Bookings, payments, and third-party platforms

The website may integrate or link to third-party platforms for bookings, payments, and communications, including Acuity Scheduling, Stripe, and WhatsApp.

A booking is confirmed only once payment is completed and our confirmation is sent. All operational conditions of a booked service are governed by Part 3.

We do not control or guarantee the availability, continuity, or security of third-party platforms.

2.9 Prices and currency

Unless stated otherwise, prices are shown in US dollars (USD) for reference. Final prices are confirmed during the booking process and may vary based on multiple factors. Tips are optional and not included.

If a pricing error occurs, we may correct it and give you the option to confirm or cancel the booking.

2.10 Prohibited uses

You agree not to:

  • Violate applicable laws or regulations.
  • Provide false or misleading information.
  • Interfere with the security or functionality of the website.
  • Copy, extract, or reuse content without authorization.
  • Introduce malicious code.
  • Harass or abuse our staff or partners.

We may suspend or restrict access in the event of a violation.

2.11 Intellectual property

All website content is owned by Safe Transfers Bogota LLC or used under license and is protected by intellectual property laws. Unauthorized use of trademarks, logos, text, images, or designs is prohibited.

2.12 Content you submit

By submitting comments, reviews, or suggestions, you grant us a non-exclusive, worldwide, royalty-free license to use that content for operational, commercial, and service-improvement purposes, without disclosing confidential personal information.

2.13 Third-party links and services

The website may link to third-party services. We are not responsible for their content, availability, policies, or security, and use of those services is at your own risk.

2.14 Disclaimer of warranties

The website is provided “as is” and “as available.” We do not guarantee uninterrupted operation or absolute accuracy of content. Nothing on the website constitutes legal, medical, safety, or professional advice.

2.15 Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website.

Our total liability for direct damages arising from use of the website will not exceed the greater of the amount you paid us through the website in the previous three (3) months or USD 100.

This limitation does not apply to death or personal injury caused by our negligence, to fraud, or where limitation is prohibited by applicable law, including the rights of consumers under Colombian consumer protection law.

2.16 Indemnification

You agree to indemnify and hold Safe Transfers Bogota LLC harmless from claims arising out of your misuse of the website, your breach of these Terms, or your violation of third-party rights.

2.17 Privacy

Use of the website is governed by our Privacy Policy, set out in Part 1 of this document.

2.18 Time limit for claims

Any claim relating to the website must be brought within twelve (12) months of the event giving rise to it. This does not shorten any period that applicable law grants to consumers.

2.19 Force majeure

We are not liable for delays, interruptions, or failures caused by events beyond our reasonable control, including traffic, weather, natural disasters, road closures, airport restrictions, authority checkpoints, protests, strikes, civil disturbance, government decisions, airline disruptions, third-party accidents, safety conditions, and failures of communications or technology platforms.

2.20 Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, and any dispute will be resolved before the competent courts of the State of Wyoming. This does not limit the rights of consumers contracting in Colombia, who retain the protections of Colombian consumer protection law and may bring claims before the Superintendencia de Industria y Comercio or the competent Colombian courts.

2.21 Language

This document is published in English and Spanish. The English version is the controlling version and prevails in the event of any discrepancy, except where applicable law requires otherwise. For consumers contracting in Colombia, nothing in this clause limits the rights granted to them under Ley 1480 de 2011 or Ley 1581 de 2012, and in the event of a discrepancy the Spanish version will be used to interpret those consumers’ rights.

2.22 Electronic communications

You agree to receive electronic communications, including email, SMS, and WhatsApp, related to your use of the website and our services. These communications are made in accordance with our Privacy Policy and applicable data protection law.

2.23 Cookies and analytics

The website uses cookies and similar technologies for functionality and analytics, including Google Analytics. By using the website you consent to their use. You can limit or disable cookies in your browser settings, though some features may not function properly.

2.24 General provisions

  • Severability: if a clause is found invalid, the remaining clauses continue to apply.
  • No waiver: failure to enforce a right does not waive it.
  • Assignment: we may assign these Terms in a corporate transaction.
  • Entire agreement: these Terms constitute the entire agreement regarding use of the website.

Part 3 — Booking Terms and Conditions

Key things to know

  • We book and coordinate your transportation. The vehicle is operated by an independent licensed transport company.
  • Bookings are confirmed only after full payment.
  • Cancel at least 24 hours ahead for a full refund. Cancel later and you receive a credit valid for 12 months.
  • Airline disruptions, natural disasters, serious illness, and the death of the client or a close family member are refunded in full at any time.
  • Free wait time: 1 hour after landing for domestic flights, 2 hours for international flights, 40 minutes for all other services.
  • If we cannot reach you and you do not appear within the free wait time, the booking is a No-Show. No-Shows are not refunded, and you may reschedule once within 2 months.
  • This summary is for convenience only. The full terms below apply.

These Terms apply to all private transportation bookings made with Safe Transfers Colombia, including airport pickups and transfers, point-to-point transfers, hourly service, and full-day service in Colombia, where available. By making a booking, you accept these Terms.

If you book under a separate written agreement between Safe Transfers Colombia and a company, hotel, or agency, that agreement prevails over these Terms to the extent they conflict.

3.1 Our role

Safe Transfers Colombia provides booking, coordination, and client support services for private ground transportation in Colombia. We do not own or operate vehicles, and we do not employ drivers.

All transportation is performed by independent transport companies that hold the licenses, authorizations, and insurance required under Colombian law, together with their own drivers and vehicles. Each transport company is solely responsible for the operation of the vehicle, the conduct and licensing of its drivers, vehicle condition and maintenance, insurance coverage, and compliance with all transport regulations.

When you make a booking, your booking contract is with Safe Transfers Colombia. We are responsible for the services we provide: accurate booking, selection and coordination of a licensed transport company, communication and support before and during the service, and the commitments set out in these Terms. We are not responsible for the operation of the transport itself, which is the responsibility of the transport company.

We select transport companies based on licensing, insurance, and service standards. The identity of the transport company operating a specific service is available on request.

3.2 Scope and availability

Services are subject to availability by city, route, date, time, and operational capacity. Not all services are available in all locations or at all times.

Each booking is coordinated solely on the basis of the information provided at the time of booking and the confirmations and instructions sent by our team via WhatsApp, SMS, or email.

We may decline, modify, or cancel a booking if operational, safety, or legal requirements are not met.

3.3 Booking and payment

A booking is confirmed only with full payment through our secure payment system (Stripe), unless we confirm a different arrangement in writing and provide separate payment instructions.

Prices are quoted and charged in USD unless stated otherwise during the payment process. Tips are optional and not included.

Confirmation is sent to the email address, SMS number, or WhatsApp number provided.

We may adjust or decline a booking made with incorrect, incomplete, or fraudulent information.

3.4 Vehicle capacity

A booking corresponds to the stated passenger and luggage capacity. Exceeding that capacity may require a change of vehicle, a fare adjustment, or a new booking.

3.5 Communication and client availability

Coordination takes place mainly through WhatsApp, email, or SMS, including updates, meeting point details, and pickup instructions. You must provide a valid phone number with country code and keep WhatsApp active on that device.

Messages are considered received when sent, even if they are not read or the content is filtered.

We are not responsible for failed pickups caused by incorrect contact details, phone settings, lack of connectivity, or unread messages.

Language support. Our operations team assists in English or Spanish. Drivers usually speak Spanish. In-person bilingual assistance beyond the standard service is available on request and subject to availability.

3.6 Cancellation and changes

Bookings cancelled at least 24 hours before the scheduled service time are refunded in full.

Bookings cancelled less than 24 hours before the scheduled service time are not eligible for a cash refund. Instead, the client receives a credit for the full amount paid, valid for 12 months and usable for any service we book.

The credit is personal to the client and cannot be transferred or exchanged for cash, though it may be applied to bookings made by the client for any passenger. It may be used across one or more bookings until exhausted. If a new booking costs more than the available credit, the client pays the difference; if it costs less, the remaining balance stays available. Any unused balance expires 12 months from the date the credit was issued.

Cancellations caused by demonstrable events outside the client’s control are refunded in full at any time. These include airline disruptions such as flight cancellation, rescheduling, or significant delay; natural disasters and comparable events; serious illness that prevents travel, affecting the client, a travel companion on the same booking, or an immediate family member (spouse or permanent partner, or first-degree relative); and the death of the client, their spouse or permanent partner, or a first-degree relative. Other circumstances are reviewed individually through our authorized channels.

Changes to date, time, or pickup location requested at least 24 hours in advance are made at no charge, subject to availability. Changes requested later are subject to availability and may require a fare adjustment.

3.7 No-Show

A No-Show occurs when the assigned logistics coordinator attempts to reach the client at the scheduled time and throughout the maximum free wait time, using all available channels (direct call, WhatsApp call, email, and SMS), receives no response, and the client does not appear at the agreed meeting point with the host or driver.

No-Shows are not refunded. The client may reschedule the service once within 2 months, subject to availability.

3.8 Extended waiting

For airport and point-to-point transfers, if the client requests waiting beyond the free wait time and the driver can remain available, the additional time is charged in 30-minute increments at half the extra-hour rate for the vehicle shown in Part 4, and is confirmed by payment link. If the driver cannot remain available, the booking is handled under the No-Show and rescheduling rules.

For hourly and full-day service, waiting within the booked hours is part of the service.

3.9 Refunds

Approved refunds are issued to the payment method used for the booking and are processed within 5 to 10 business days, subject to the bank’s own processing times.

Refunds are issued in USD, the currency in which the booking was charged. Where your payment method uses another currency, the amount you receive may differ from the amount you paid because of exchange rate movements or fees charged by your bank or card issuer. These differences are outside our control.

3.10 Right of withdrawal

Where the right of withdrawal under Colombian consumer protection law applies, it may be exercised within 5 business days of purchase and the amount paid will be returned. This right does not apply to services scheduled for a specific date, as permitted by Ley 1480 de 2011.

3.11 Safety, conduct, and personal items

You are responsible for your belongings. We are not responsible for items lost or forgotten after the service ends.

Smoking and vaping inside the vehicle are prohibited. Damage or excessive soiling may result in additional cleaning or repair charges applied by the transport company.

The following may not be transported: illegal substances; weapons, except those carried by duly authorized security personnel, such as a contracted escort service, in accordance with Colombian law; explosive, flammable, or hazardous materials; and any item whose transport is prohibited by law. The transport company may refuse or end a service where these items are present, or where the client’s condition or conduct poses a safety risk. In those cases the booking is not refunded.

Minors. Minors must travel accompanied by a parent, guardian, or responsible adult designated at booking. We do not provide unaccompanied-minor service.

3.12 Service interruptions and force majeure

We are not liable for delays, interruptions, or failures caused by events beyond our reasonable control, including traffic, weather, natural disasters, road closures, airport restrictions, authority checkpoints, protests, strikes, civil disturbance, government decisions, airline disruptions, third-party accidents, safety conditions, and failures of communications or technology platforms.

Where such an event affects a booking, we make reasonable efforts to coordinate an alternative.

3.13 Limitation of liability

We are not liable for indirect, incidental, special, consequential, or punitive damages, including missed flights, missed connections, lost business, or lost opportunities.

Our total liability for direct damages arising from a booking will not exceed the greater of the amount paid for the specific booking giving rise to the claim or USD 250.

This limitation applies to the booking and coordination services we provide. It does not limit the liability of the transport company operating the service, which is responsible for the operation of the vehicle and maintains its own insurance. It does not apply to death or personal injury caused by our negligence, to fraud, or where limitation is prohibited by applicable law, including the rights of consumers under Colombian consumer protection law.

3.14 Indemnity

You agree to indemnify and hold harmless Safe Transfers Bogota LLC, its owners, employees, and partners from claims arising out of your breach of these Terms, your misuse of the service, or damage, injury, or legal claims caused by you.

3.15 Time limit for claims

Any claim relating to a booking must be brought within twelve (12) months of the event giving rise to it. This does not shorten any period that applicable law grants to consumers.

3.16 Privacy and data

We collect information only to provide the service, including name, contact details, pickup and destination details, flight information, and special requests. Information is shared only with authorized staff and the assigned transport company and driver.

Payments are processed securely through Stripe. We do not store full card details. Our full Privacy Policy is set out in Part 1 of this document.

3.17 Governing law, jurisdiction, and language

The governing law, jurisdiction, and language provisions in Part 2 apply equally to these Booking Terms and Conditions.

Part 4 — Service-Specific Conditions

These conditions apply in addition to the Booking Terms and Conditions in Part 3. Cancellation, changes, No-Show, refunds, and liability terms are set out in Part 3 and apply to every service below.

Each service is a booking and coordination service. Transportation is performed by an independent licensed transport company, as described in Part 3.

4.4 Optional extras

The following extras are arranged with the transport company or provider on the client’s behalf, at the prices shown. All requests are subject to availability.

Pets (dogs)

The client must notify us at the time of booking. Where the dog qualifies, there is no charge. If the dog belongs to a breed on the international list of dangerous breeds, it must wear a muzzle for the entire trip and the charge is USD 20. In all other cases the charge is USD 20. At least 24 hours before the scheduled time, the client must send the applicable certificates, a rabies vaccination record no older than 1 year, and proof of deworming no older than 3 months. Photographs or PDF copies sent to bookings@safetransferscolombia.com are accepted.

Pets (cats)

The client must notify us at the time of booking. Our team will contact the client to confirm whether the cat has a special status, such as an emotional-support cat certified by a licensed psychologist, in which case there is no charge. Otherwise the charge is USD 20. The cat must travel in a carrier for the entire service. At least 24 hours before the scheduled time, the client must send the applicable certificates, a rabies vaccination record no older than 1 year, and proof of deworming no older than 3 months.
